The legal status of living apart while remaining legally married. Parties who legally separate may petition for property division and support rights, and in all ways end their marital relationship while retaining the status, usually for religious reasons or to retain insurance benefits.
Issues such as child custody child support, visitation and spousal/partner support are address in a separate agreement called a Stipulation, which becomes part of the Judgment.
Legal Separation also sets the stage for a divorce to follow. It is likely that if you eventually divorce, the court will assume that you were happy with the stipulation you were working under and that agreement should carry over to the divorce settlement agreement.
