Child support is usually paid by the partner with the larger income, and based on the custody-time split the parties have.   Determining child support is done with the use of special legal software that calculates support by a formula agreed on by the state legislature.   A calculator can also be found on the State of California’s web site: http://www.childsup.ca.gov/resources/calculatechildsupport.aspx.

The goal of the Court is to make sure that the children are supported adequately and do not become the responsibility of the State of California.  Both the paying party and the payee may ask the Court for a reduction in Child Support if their income has changed or their custody time split has changed  (“changed circumstances”).    It is always best to negotiate your own agreement because the Court is empowered to do only one thing:  like Solomon, he must divide everything down the middle.  Moreover, the Court seldom interferes with a reasonable custody arrangement proposed by parents.
